Subject Matter

These workshops discuss complex issues for cases which do not meet the automatic ROS visa conversion process, and will include family sponsorship and potential false information PIC 4020 and character issues. We also look at the recent High Court decision in NZYQ and changes to the Return Pending Visa including 21 conditions and new criminal offences. Lastly we look at specific character issues for protection visas and the citizenship character issues definition.

The full day will comprise the following 2 hour workshops:

TPV & SHEV to ROS (8.30am to 10.30am)

This workshop looks at complex cases which are not auto ROS convert cases (except for character cases) including revision of statutory bars issues, ministerial intervention, DBB16 cases, and discussion about the forthcoming replacement of the AAT with Administrative Review Tribunal which is relevant for those who are not auto ROS converts.

Post ROS (11.00am to 1.00pm)

This workshop will focus on Family visa cases including Partner visas and Child issues for applicants and sponsors including s48 and sch 3 issues for onshore applicants. Case studies on issues such as potential DNA for children requests, age limitations for children, non-disclosure of family members, PIC 4020, s109 cancellations, and character of sponsor will be discussed.

High Court - NZYQ and Return Pending visas (1.45pm to 3.45pm)

Most of the workshop will focus on the Return Pending visas as they are "messy" and have 21 conditions. Also, some recent cases citing NZYQ in Federal Court and at the AAT will be discussed. Some of these cases include cases people who do not meet the ROS for Character reasons. 

Character issues for Protection Visas (4.00pm to 6.00pm)

This workshop will discuss Character issues for Protection cases and will cover Direction 99, Citizenship issues and Character. Case studies will be included.
