Subject Matter

 

The range of powers available to cancel temporary or permanent visas has expanded and are increasingly used, but there remain opportunities to prevent threatened cancellation in many cases or overturn cancellations that have occurred.  

This workshop will explore the various (non-character related) cancellation powers available under the Migration Act, including ss 109, 116, 128, 133A, 134 and 137Q, and the relevant legal principles and policy considerations which must be addressed. There will be a combination of detailed explanations of the current powers and practical case studies to equip participants dealing with a range of visa cancellation issues and provide practical tips for handling these matters.
