Family Violence

Subject Matter

The Department of Home Affairs is clear that family and domestic violence is not tolerated in any circumstance.

Unfortunately, many temporary visa holders and visa applicants find themselves in abusive or unsafe relationships, whether that be with an Australian spouse or a fellow visa holder who is a member of their family unit.  The family violence provisions were introduced into the Migration Regulations to ensure visa applicants do not remain in relationships where they fear for their safety in order to stay in Australia. However, very few visa subclasses have these family violence provisions, and those that do have strict evidentiary requirements and processes that must be satisfied and followed.

This workshop aims to introduce participants to the family violence provisions and to understand their application to non-citizens at various stages of their migration journeys.
